1. Acceptance of Terms
By accessing and using GearRent ("Platform"), you accept and agree to be bound by and abide by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
2. Use License
Permission is granted to temporarily download one copy of the materials (information or software) on GearRent for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:
- Modifying or copying the materials
- Using the materials for any commercial purpose or for any public display
- Attempting to decompile or reverse engineer any software contained on GearRent
- Removing any copyright or other proprietary notations from the materials
- Transferring the materials to another person or "mirroring" the materials on any other server
- Harassing, threatening, or defaming other users
- Engaging in any fraudulent or illegal activities
3. User Accounts
3.1 Account Creation
To use certain features of GearRent, you must create an account. You agree to:
- Provide accurate, current, and complete information
- Maintain the confidentiality of your password
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized access
3.2 Age Requirement
You must be at least 18 years old to use GearRent. By creating an account, you represent and warrant that you are 18 or older.
3.3 Account Suspension
We reserve the right to suspend or terminate accounts that violate these terms or engage in harmful behavior.
4. Rental Terms
4.1 Equipment Rental
By booking equipment through GearRent:
- You agree to rent the equipment for the specified duration and rental terms
- You are responsible for the safekeeping and condition of rented equipment
- Equipment must be returned in the same condition as received (normal wear excepted)
- You are liable for damages or loss beyond normal wear and tear
4.2 Damage and Loss Policy
- Minor damage (normal wear): No additional charge
- Moderate damage: Repair costs billed to renter
- Severe damage or loss: Full replacement cost plus additional fees
- Damage documentation required for disputes
4.3 Cancellation Policy
- Free cancellation up to 24 hours before rental start
- 50% refund if cancelled 24-12 hours before rental start
- No refund if cancelled less than 12 hours before rental start
- Owner may cancel with 48-hour notice
5. Payments and Fees
- All payments must be made through the platform's payment gateway
- Rental fees are non-refundable except as per cancellation policy
- Damage fees are determined by equipment and damage assessment
- Dispute fees apply if rental terms are violated
- All prices are in Indian Rupees (INR)
6. Owner/Provider Responsibilities
Equipment owners agree to:
- Provide equipment in safe, clean, and working condition
- Maintain accurate product descriptions and pricing
- Respond to rental inquiries within 24 hours
- Honor confirmed bookings
- Not discriminate against renters based on protected characteristics
- Report any damage caused by renters promptly
- Comply with all applicable laws and regulations
7. Renter Responsibilities
Renters agree to:
- Use equipment only for lawful purposes
- Follow all instructions provided by the owner
- Not sublease or rent to third parties
- Maintain equipment properly during rental period
- Return equipment on time in agreed condition
- Treat the owner and their property with respect
- Comply with all applicable laws while using equipment
8. Prohibited Activities
You agree not to use GearRent for:
- Illegal activities or content
- Fraud, forgery, or misrepresentation
- Threatening, harassing, or abusive content
- Intellectual property infringement
- Spam, phishing, or malware distribution
- Competitive intelligence gathering
- Violating others' privacy or rights
9. Dispute Resolution
9.1 Dispute Process
- Report dispute within 7 days of incident
- Provide evidence (photos, messages, documentation)
- GearRent team reviews claim (5-7 business days)
- Decision communicated to both parties
- Appeal option available within 7 days
9.2 Arbitration
Disputes shall be resolved through binding arbitration under Indian Arbitration and Conciliation Act, 1996, rather than in court.
10. Limitation of Liability
GearRent and its owners/operators are not liable for:
- Indirect, incidental, special, or consequential damages
- Loss of profits, revenue, or business opportunities
- Data loss or corruption
- Third-party conduct or communications
- Service interruptions beyond our control
11. Warranties Disclaimer
GearRent is provided "as is" without warranties of any kind. We do not guarantee:
- Continuous, uninterrupted service
- Error-free operation
- Equipment fitness for particular purposes
- Equipment condition beyond owner descriptions
12. Indemnification
You agree to indemnify and hold harmless GearRent, its operators, and employees from any claims, damages, or losses arising from your use of the platform or violation of these terms.
13. Insurance and Safety
- Renters should consider personal insurance for rented equipment
- Check equipment safety before use
- Report hazards or defects immediately
- Use equipment only as intended
14. Intellectual Property
All content, features, and functionality on GearRent are owned by GearRent or its licensors. You may not:
- Reproduce or republish content without permission
- Modify or create derivative works
- Use content for commercial purposes
- Sell or transfer platform access
15. Modifications to Service
GearRent reserves the right to modify or discontinue services with or without notice. We are not liable for any changes to the platform.
16. Termination
GearRent may terminate or suspend your account:
- For violation of these terms
- For fraudulent or illegal activity
- For abusive behavior toward other users
- Upon your request
17. Governing Law
These terms are governed by the laws of India, specifically the jurisdiction of the courts where GearRent is registered. You agree to submit to the exclusive jurisdiction of such courts.
18. Severability
If any provision of these terms is found invalid or unenforceable, the remaining provisions shall continue in full force and effect.
19. Entire Agreement
These Terms & Conditions constitute the entire agreement between you and GearRent regarding platform use, superseding any previous agreements or understandings.
